These terms & conditions relate to online subscriptions to The Wine Gang.
By subscribing to The Wine Gang (hereafter 'TWG') you accept the terms and conditions
set out below.
Copyright
You acknowledge that TWG owns or controls all rights relating to all materials contained
in this web site. You will ensure that the intellectual property rights of TWG and the
moral rights of TWG as authors of materials from this web site are not infringed. All
tasting notes and other texts and photographs on this website are copyright and may not
be reproduced by any means without the prior consent of The Wine Gang. If permission is
granted, all notes must be credited to 'www.thewinegang.com' and if featured in electronic
media, must link back to this web site.
Payment
Your subscription must be fully paid before you will be provided with access to TWG
Product. You agree to pay all fees and charges incurred in connection with the
subscription, including but not limited to applicable taxes, at the rates in effect when
the charges were incurred.
Personal subscriptions
Payment of an annual, or six-monthly subscription entitles individuals to one
non-transferable license to access our reports and database. Subscribers are NOT permitted
to:
- Pass on thier username and password for others to use
- Print-off or transmit any TWG materials for unauthorised users
- Allow copies of TWG materials to be stored or accessed by unauthorised users
- Alter, amend, modify or change TWG materials
- Mount or distribute any TWG material on any electronic network (including without
limitation the Internet and the World Wide Web)
- Make TWG materials available in any other form or medium or create derivative works.
Trade and Solo Trader memberships
Payment of an annual trade subscription gives a limited entitlement to one company
to reproduce TWG materials within these terms and conditions.
Permission to reproduce materials applies only to the company that has taken a trade
subscription, and not to its clients, customers, or any other company associated with
the trade member. The subscriber may reproduce tasting notes in its own marketing and
promotional literature, within the limitations stated below.
All tasting notes must be credited to 'The Wine Gang - www.thewinegang.com' and if featured
in electronic media, must link back to this web site.
For full Trade memberships, up to 10 people from the subscribing company may access the TWG web site. For Solo Trader memberships only one person may access the TWG website.
Solo Trader memberships apply to companies with only one premises and a maximum of four employees. Larger businesses must take a full Trade membership.
Trade subscribers are NOT permitted to:
- Reproduce whole articles in any form on any media
- Alter, amend, modify or change TWG materials
- Pass on their username and password for anyone outwith their business to use
Extent of Trade and Solo Trader memberships
A wine trade association, generic organization, company or brand belonging to a trade member is a separate
entity for the purposes of trade subscriptions. A trade membership to TWG does not therefore entitle such an entity belonging
to a trade member to use TWG notes. Such separate entities will be required to take out their own trade subscription for use of TWG notes in press releases, P.O.S, on web
sites or in any other marketing and publicity materials.
Breaches of these terms
TWG reserves the right to withdraw access in the event of deliberate and/or systematic
breach of these conditions by any subscriber.
Disclaimers regarding product
TWG does not make any warranty (i) that the Product will be usefully accessible in every
hardware/software environment; (ii) to the accuracy or completeness of any information
contained in the Product; or (iii) to their merchantability or fitness for a particular
purpose. TWG will have no liability to any person for any loss or damage arising out of
use of, or inability to use, the Product.
The Product is supplied on an 'as available' basis. TWG excludes all liability whatsoever,
to the fullest extent permitted by law, in respect of any loss or damage resulting or
arising from any non-availability or use of this website or of any other website linked
to it, or from reliance on the contents of this website or any material or content
accessed through it. TWG will not be liable for any damages caused to individuals as a
result of your use of the Product on the website due to the website's malfunctioning nor
on any other account. No damages will in any event be in excess of the amount that you
paid for the Product.
Renewals and termination of subscription
This Agreement will commence on your acceptance of these terms of use, such acceptance
being indicated by you taking a subscription. The Agreement will remain in full force
and effect for the duration of the subscription period or until a) you notify TWG of
your decision to terminate your subscription prior to the time of renewal, or b) TWG
terminates your subscription in accordance with this Agreement. In the event that you
commit a material breach of this Agreement, TWG may at its discretion terminate this
Agreement, and/or exercise all rights and remedies which may be available to it in law
or equity. TWG may terminate this Agreement at any time. In the event that TWG terminates
this Agreement for reasons other than your breach of this Agreement, you will be refunded
the pro rata portion of any subscription fees that you have paid. Upon termination of
this Agreement, you agree to continue to adhere to the provisions of this Agreement
relating to any Intellectual Property of the Rightsholder. Termination of this Agreement
will not affect any payment due to TWG under the terms of this Agreement, nor affect
any claim which TWG may have for damages or otherwise.
Changes to agreement
TWG may change, add or remove portions of this Agreement, at any time. Your continued
use of the website will be deemed to constitute your consent to such changed terms.

You consent to our holding and using your personal data in accordance with our
